Man jailed for months over $5 theft found dead in cell
A family wants answers about how their son died in jail.
Last week, 24-year-old Jamycheal Mitchell was found dead in his jail cell at Hampton Roads Regional Jail in Virginia. According to court documents, he was arrested in April for stealing $5 worth of items from a 7-Eleven and denied bail.
"It's obvious that he did not receive the help that he needed and that's the main issue."
Family's attorney
Autopsy results are still pending but the master jail officer says Mitchell's death was caused by "natural causes" and there was no sign of injury to his body. His family's attorney told WAVY that Mitchell struggled with mental illness and the family suspects he didn't receive the help he needed.
"I think it's two fold. It's the death of her son obviously but it's also the circumstance surrounding his death. It's obvious that he did not receive the help that he needed and that's the main issue."
Medics at the jail say Mitchell refused to take his medication and officials also confirmed he refused to eat. The Guardian reports Mitchell was supposed to be transferred to a mental health hospital for treatment, but there was no room for him.
Prosecutors are seeking an indictment in the case.

If there was no room at the Mental Hospital, and the man was not eating, and refused to take his medication, in that case, the police should have had an ambulance take him to the nearest General or Teaching Hospital available, and had him treated under guard, until such time as there was an opening for a bed at the Mental Hospital.
Coulda, shoulda, woulda. What should have been done was.......this guy should not have broken the law.
Everyone is always looking for something or someone to blame. How about holding people accountable for their own actions? It doesn't matter how trivial the crime may seem, it's still a crime and we can't continue to give the appearance of no accountability for people's own actions. Then there are people like you aljoramaggio. I think you truly have the best of intentions but you don't realize you are becoming an enabler when you look for others to blame. Lets get back to basics and hold the people accountable that should be. It's a sad situation but we have allowed things to get so far out of control that it seems harsh to go back to what we should have been doing from the beginning, like we used to years ago.
The family had not gotten him the mental health that it sounds like he needed, so he steals, gets locked up, he refuses meds and food and now he becomes an important memeber of the family...lawsuit...money...yeah. This is getting old. Agan...the family blames others for not getting the help they say he needed.
They guy was a criminal, he broke the law! Let's address THAT issue first!
Had he been an upright standing citizen, he wouldn't have fvcking DIED IN A JAIL CELL!
He would have been at HOME treating his conditions.
I have zero sympathy for him or his family.
You don't want to die in a jail cell, STOP DOING **** THAT PUTS YOU IN A JAIL CELL.
Very sad. So many kids growing up in single parent families are neglected and grow up dysfunctional unable to transition into responsible adults. We do not know the family profile, but he must have been hungry to be stealing food. 20/20 hindsight, but.if mental heath facility had no beds, the ER was the next best option.
"According to court documents, he was arrested in April for stealing $5 worth of items from a 7-Eleven and denied bail."
Sounds like everything in the Eighth Amendment of the Bill of Righs were violated here. Denied bail over a $5.00 shoplifting incident, and imprisoned for months?
I don't know who his attorney was at the time, but he should be sued big time.
SUE SUE SUE....i AM SICK OF IT....everyone is always looking for a payout ....His family is not searching for answers...they are searching for a way to get a pay out.....
Yeah, and they probably deserve a payout. How in God's name do we let someone sit in jail for months over a $5 theft? He must have been appointed an attorney if/when he was arraigned. Any police officer with any common sense would have had him settle up with the store and sent him on his way. This is the most bizarre incident I have ever heard of. But of course, it's Virginia where my friend was driving 8 miles over the speed limit and got a $1200 plus court costs. And NO he was not drinking, No, he had no drugs or contraband in the car, and NO, he did not disrespect the officer, and NO he was not missing any of his documentation. Just a straight speeding ticket written for going 8 miles over the speed limit.
